Agreement to Terms

Limitation of Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SITE EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESSING THE SITE DURING THE TWELVE MONTHS PRECEDING THE CLAIM.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Cuyahoga County, Ohio.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cloud9 Payments regarding your use of the Site. These Terms supersede any prior agreements or understandings, whether written or oral, relating to the same subject matter.
